Ratio Decidendi

The application for leave to commence judicial review was filed ten years after the one-off decision to impose the SRF fee, making it grossly out of time under Order 53 of the White Book. The High Court correctly refused leave, as the cause of action arose in 2005/2006 and there was no continuing breach. The court has no discretion to extend time where limitation is set by statute, and the principle of 'detrimental to good administration' from the Supreme Court Act, 1981 is not applicable in Zambia. The appeal is dismissed.
