Ratio Decidendi

The Plaintiff, through its agency relationship with Zambian Towers, is liable to pay rent to the 1st Defendant. The rent was properly increased by notice to ZMW7,440.00 per month per antenna from April 2016. The Plaintiff's continued occupation created a tenancy at will, obligating payment at the revised rate. The execution of the warrant of distress was legal, but the quantum of arrears must be ascertained by the Deputy Registrar.
