The trial judge correctly exercised discretion in granting the interlocutory injunction as the 1st Respondent established a serious question to be tried, a prima facie right, and the risk of irreparable injury. The existence of a Certificate of Title does not preclude injunctive relief where there is evidence the title may be vitiated. The alleged non-disclosure was immaterial to the decision. The appeal fails on all grounds.
