Ratio Decidendi

The Court of Appeal held that the learned Judge below properly exercised her discretion in refusing to review her earlier ruling, as the appellant failed to present sufficient grounds for review under Order 39 of the High Court Rules. The Court found that the matters before the High Court and Subordinate Court arose from the same facts and parties, justifying the finding of multiplicity of actions. The refusal to review the award of costs was also upheld as costs follow the event and are not a ground for review.
