Ratio Decidendi

The Supreme Court of Zambia has jurisdiction under Article 41(2) of the Constitution to hear and determine Presidential Election Petitions and, if proven, to grant remedies including nullification of the election. Section 18 of the Electoral Act does not directly apply to Presidential Petitions, but the Court may consider any question relating to the validity of the election or compliance with the law. The 180-day limitation in Section 27(1) of the Electoral Act does not apply to Presidential Petitions. A vacancy in the office of President following nullification is provided for under Article 38 of the Constitution.
