Ratio Decidendi

The respondent was not a bona fide purchaser for value because the land in question was already held on title by Swetrade Investments Limited, as confirmed by the Lands Tribunal judgment and the commissioner of lands. The certificate of title issued to the respondent was erroneous and subject to cancellation. The trial judge erred in law and fact in finding the respondent a bona fide purchaser and in awarding damages for trespass against the appellant.
