Ratio Decidendi

The Applicant proved the existence of the loan and the 1st Respondent's default. However, the Applicant failed to prove that an equitable mortgage was created over Subdivision No. 1103 of Farm No. 10435 due to inconsistencies and lack of evidence. The Applicant is entitled to recover the outstanding sum with interest and, upon default of payment within 90 days, to foreclosure and sale of House No. 286, South Kalengwa and the Toyota Chaser vehicle, but not Subdivision No. 1103 of Farm No. 10435.

Orders

  • 1st Respondent to pay K74,350.42 plus agreed interest from 6 July 2020 to judgment, and thereafter at the prevailing commercial bank lending rate until full payment.
