Ratio Decidendi

The appellants failed to prove on the balance of probabilities that the sum of USD 9,294,387.00 was advanced and due under the equitable mortgages. Although the action was properly characterized as a mortgage action and equitable mortgages existed by deposit of title deeds, the appellants did not provide sufficient documentary evidence or a proper statement of account to substantiate their claim. The lower court erred in raising procedural issues under Order 88 at judgment, but correctly found the appellants failed to discharge their burden of proof. The respondents' counterclaim for return of securities was granted as the appellants' claim failed.

Court Disposition

Appeal dismissed with costs; appellants to return all securities to respondents.

Orders

  • Appellants to hand back all title deeds held as security to the respondents forthwith.
  • Costs to respondents, to be taxed if not agreed.
