Ratio Decidendi

There are serious questions of law to be tried, including allegations of fraud and whether the Defendant foreclosed on the wrong property, giving the Plaintiffs a clear right to relief. However, the High Court has no jurisdiction to grant an injunction regarding Subdivision B, as the Supreme Court has already determined that matter. The interim injunction is confirmed only with respect to Subdivisions A and C.
