Procedural Posture

Application for Stay of Execution Pending Leave to Appeal / Ruling on Application for Stay of Execution Pending Determination of Application for Leave to Appeal

  1. 1 Whether a single judge of the Supreme Court has jurisdiction to grant a stay of execution of a judgment of the Industrial Relations Court after the Supreme Court dismissed an appeal on a technicality
  2. 2 Whether the application for leave to appeal has real prospects of success to justify a stay of execution
  3. 3 Whether the judgment of the Industrial Relations Court is amenable to a stay after the Supreme Court's dismissal of the appeal

Ratio Decidendi

The application for a stay of execution is declined because the application for leave to appeal does not have sufficient prospects of success, and no leave to file the application for leave to appeal out of time was obtained. The applicant failed to demonstrate cogent reasons for the grant of leave or a stay, and the jurisdictional objections raised by the respondents are not sustained as the judgment sought to be stayed is that of the Industrial Relations Court, not the Supreme Court. However, the merits do not justify a stay.
