Ratio Decidendi

The bank was liable for the second unauthorized debit because it failed to ensure that the transaction was properly mandated by the respondent. The use of the PIN for the first transaction did not authorize the second debit. The respondent was not required to pursue Kenya Airways; the bank, having debited her account without authority, was responsible. The bank was not justified in closing the account without notice in the absence of a contractual term to that effect. The award of interest at the appellant's ruling rate and on a negative balance was a misdirection; nominal damages were appropriate due to the lack of evidence of actual loss.

Appeal substantially dismissed; some grounds allowed in part.

  • The debit of K3,471.50 made on 12th August 2010 to the respondent's account to be reversed, restoring the account to its status as at that date.
