Procedural Posture

Civil Appeal / Judgment on Appeal

  1. 1 Whether there was a valid insurance contract covering the stolen vehicle
  2. 2 Whether the defendant (broker) was professionally negligent in failing to effect insurance cover
  3. 3 Whether the loss in South Africa was covered by the insurance policy

Ratio Decidendi

The appeal failed because the plaintiff did not plead negligence, and the claim was based on contract. There was no valid insurance contract covering the vehicle at the time of loss in South Africa, as the broker failed to timely notify the insurer and remit the premium, and no territorial extension was obtained. The only successful ground was that the trial court erred in ordering the plaintiff to pay the third party's costs; such costs should be borne by the defendant who joined the third party.

Court Disposition

appeal dismissed except on costs

Orders

  • Appeal dismissed on all grounds except ground four relating to costs.
  • Defendant to pay the costs of the third party.
