Ratio Decidendi

The Tribunal found that the widespread distribution of meat to voters in Chalata Ward on the eve and day of the election, orchestrated by Lawrence Mwansa, the 1st Respondent’s campaign manager and agent, constituted a corrupt practice under the Electoral Process Act. This misconduct was sufficiently widespread to have potentially prevented voters from freely electing the candidate of their choice. The Tribunal was not satisfied that the other allegations were proved to the required standard or attributable to the 1st Respondent or her agents.
