The diagram attached to the plaintiffs' certificate of title accurately describes the property as subdivision 225 of subdivision A of Farm 609, Lusaka, not Stand 225, Chelston. The plaintiffs' title was first in time and conclusive. However, the 2nd defendant, having conducted due diligence and purchased without notice of the plaintiffs' claim, is an innocent purchaser for value. The plaintiffs are not entitled to possession but must be allocated an alternative piece of land by the 3rd defendant. The claim for damages for improvements fails for lack of evidence.
