Procedural Posture

Civil Appeal / Judgment on Appeal and Cross Appeal

  1. 1 Whether appellants were entitled to past service benefits at separation or only at retirement age
  2. 2 Whether the respondent had a company practice of paying three months' salary per year served as redundancy package
  3. 3 Whether the cross-appeal was properly before the court

Ratio Decidendi

Appellants who served for ten years were entitled to have their past service liability transferred to the pension scheme at the point of separation, not deferred to retirement age. The respondent's practice of paying three months' salary per year served applied to the appellants. The cross-appeal was incompetent for lack of proper notice and lacked merit. Costs were improperly awarded as there was no unreasonable conduct by the respondent.

Court Disposition

Appeal allowed; cross-appeal dismissed; costs order set aside.

Orders

  • Respondent to pay appellants past service benefits at separation as per company practice.
  • Respondent to pay balance of one month's salary per year served to appellants.
