Procedural Posture

Originating Summons (succession/administration of Estate) / Judgment

  1. 1 Whether the administrator must render a full inventory and account of the estate
  2. 2 Whether the applicant is entitled to a share of the estate commensurate with his age and educational needs
  3. 3 Whether the distribution of houses and pension was in accordance with the law

Ratio Decidendi

The administrator is legally obligated to render a full inventory and account of the estate upon request by an interested party or order of the court. The applicant, as a beneficiary, is entitled to a share of the estate commensurate with his age and educational needs. The distribution of the houses was not erroneous as the law allows the surviving spouse or child to determine which house devolves upon them, and the surviving spouse may occupy a house with a life interest. The administrator must ensure all beneficiaries, including the applicant, receive their due share, and must account for the distribution of all estate assets, including pension and vehicles.
