Ratio Decidendi

The Director of Public Prosecutions did not consent to prosecution for incest but only for rape or defilement. The trial court properly convicted the Appellant for indecent assault, not incest, as permitted by Section 186 of the Criminal Procedure Code. The sentencing Judge erred in substituting the charge to incest and sentencing for that offence. The conviction for indecent assault is upheld and the sentence is set at 20 years imprisonment from the date of arrest.
