Ratio Decidendi

The Respondent's letters of administration were revoked because they were obtained on the erroneous belief that he was a child of the deceased, which was an untrue statement of a fact essential in law, though made in ignorance. The 1st Applicant was also removed as administrator due to ongoing disputes and lack of cooperation among family members. The Administrator General was ordered to administer the estate. Only Natasha Mutale and Sharon Zulu, as dependants, are entitled to benefit from the estate in addition to the spouse and parent. The status of Plot 10423/20, Minestone as a matrimonial house is irrelevant; the surviving spouse may choose which house to take under the Act.
