Procedural Posture

Civil Appeal / Final Appellate Judgment

  1. 1 Whether appellants, as former employees and sitting tenants, had an accrued right to purchase the properties they occupied following a Presidential directive.
  2. 2 Whether the properties were lawfully offered and sold to the intervenors by the 1st respondent.
  3. 3 Whether the trial court erred in finding that the appellants' rights were extinguished after privatization and transfer of properties.

Ratio Decidendi

The appellants' claim to an accrued right to purchase the properties as sitting tenants failed because, at the time of the offers and sale, they were no longer employees of a ZCCM subsidiary and the properties had been lawfully excluded from the privatization. The government, as majority shareholder, exercised its discretion through the Minister of Finance and the Board, and the properties were lawfully offered to and purchased by the intervenors. The trial court's findings were upheld.
