Ratio Decidendi

The High Court Rules are not a complete code on substitution of parties; English Rules of the Supreme Court, Order 15, rule 6, may be applied to allow substitution of plaintiff where the mistake was genuine, no injustice will result, and the defendant can be safeguarded as to costs. Amendment to change rate of interest is permissible under Order 16, rule 1. Substitution of plaintiff requires written consent of the new plaintiff.
