The act of the Permanent Secretary in placing Matthews Kakungu Siame on the payroll was an administrative function and did not amount to a recommendation or recognition of chieftaincy in breach of Articles 165 and 167 of the Constitution. The selection of the Interested Party was done by the electoral college in accordance with custom, and government officials did not participate in the selection process. There was no contravention of the Constitution.
