Ratio Decidendi

The complainants were dismissed for an offence that, under the applicable disciplinary code, warranted only a verbal warning for a first breach. They were not given the full opportunity to exculpate themselves before dismissal. For those whose contracts expressly provided for the 13th cheque, the employer could not unilaterally vary this condition without consent. The dismissals were therefore wrongful and unfair, and those complainants are entitled to damages and, where applicable, the 13th cheque for 2015.
