Ratio Decidendi

The Registrar properly exercised discretion in granting leave to file complaint out of time ex-parte, as there is no statutory requirement for inter-parte hearing at that stage. Section 85(3) does not impose a time limit for applying for extension of time. The reasons advanced by the applicant, including efforts to resolve the matter and financial constraints, existed before the expiry of the mandatory period and were sufficient to justify the extension. The appeal is therefore dismissed.
