Procedural Posture

Criminal Appeal / Final Appellate Judgment

  1. 1 Whether the identification parade was properly conducted and reliable
  2. 2 Whether contradictions in prosecution evidence were material
  3. 3 Whether failure to call the doctor who conducted the post mortem was fatal to the prosecution case

Ratio Decidendi

The identification of the appellant by two eyewitnesses was reliable and not tainted by improper conduct of the identification parade; contradictions in dates were not material; the post mortem report was properly admitted and the cause of death was clear from the evidence; and failure to produce the firearm did not prejudice the appellant as there was no evidence it was found on him. The conviction was safe and the appeal had no merit.
