Procedural Posture

Civil (commercial) / Ruling on Interpleader and Stay of Execution Applications

  1. 1 Whether the Claimant and 2nd Respondent are the rightful owners of the seized property
  2. 2 Whether the Applicant Bank can pursue guarantors before exhausting primary security
  3. 3 Whether the Sheriff’s seizure was proper in law

Ratio Decidendi

The Claimant and 2nd Respondent sufficiently demonstrated ownership of the seized property (Paramount Trailer and Ford Ranger) through documentary evidence. The Applicant Bank was not entitled to seize these assets as they did not belong to the judgment debtor, and the proper sequence of enforcement requires exhaustion of primary security before pursuing guarantors. The Sheriff’s seizure of these assets was improper, and the property must be released to the rightful owners.

Court Disposition

Applications for interpleader and stay of execution allowed.

Orders

  • Stay of execution and/or sale of the disputed property confirmed.
