Ratio Decidendi

The Supreme Court held that Indo-Zambia Bank was entitled to charge compound interest based on the express provision in the mortgage deed for interest with monthly rests. The Appellants' claims could not be ranked higher than those of the secured creditor (the Bank), and the evidence showed that while the principal was repaid, interest remained outstanding. Therefore, the Bank was entitled to recover all amounts owed to it before any payment to the Appellants.
