Ratio Decidendi

The applicant failed to prove he followed the required procedure for obtaining title to land in a customary area, specifically by not obtaining consent from the chief and local authority as required by law. The respondents established a genuine claim of right and occupation predating the applicant's title. The applicant's failure to file an affidavit in reply to critical issues raised by the respondents meant those facts were deemed admitted. Consequently, the certificate of title was obtained in contravention of Section 3(4) of the Lands Act and must be cancelled.
