The property formed part of the deceased's estate and was validly included in the Will. The 1st Defendant fraudulently obtained administration and title by misrepresenting that the deceased died intestate. He had no valid title and could not pass title to the 3rd Defendant. The mortgage to the 4th Defendant was invalid as it was based on defective title. The Plaintiffs are entitled to ownership and possession of the property.
