Ratio Decidendi

The Plaintiff, not being the registered proprietor of the trademarks, is precluded by Section 7 of the Trade Marks Act from instituting proceedings to prevent or recover damages for infringement. The Defendant, as registered proprietor, is entitled to exclusive use and to restrain infringement. The Plaintiff's continued use of the trademarks constitutes infringement. However, the Defendant, having no commercial presence or proven loss, is not entitled to damages or interest but is entitled to a permanent injunction.
