Procedural Posture

Divorce / Appeal From Deputy Registrar's Ruling on Maintenance and Property Settlement

  1. 1 Whether the Deputy Registrar erred in failing to rule on the rentals from the matrimonial home
  2. 2 Whether the Deputy Registrar properly considered the respondent's income and children's needs in determining maintenance
  3. 3 Whether the ruling regarding the house sale would cause injustice to the petitioner

Ratio Decidendi

The Deputy Registrar's findings on maintenance and property settlement were not perverse or made without evidence. However, the directive regarding the sale of the house upon the youngest child reaching 21 years was unjust as it allowed the respondent to benefit from rental income without justification. The order was reviewed to require the respondent to pay the petitioner half of the monthly rental proceeds until the house is sold and proceeds shared equally.

Court Disposition

appeal partially allowed, cross-appeal dismissed

Orders

  • The house shall be evaluated at the respondent's cost by a qualified surveyor within three months and the respondent shall pay the petitioner half of the valuation price.
  • If the respondent does not comply, he shall pay the petitioner half of the monthly rental proceeds until the youngest child reaches 21 years, when the house shall be sold and proceeds shared equally.
