The respondent failed to discharge the burden of proof that the appellant lacked the power to summarily dismiss him for misconduct under the conditions of service. The trial judge misdirected by shifting the burden to the appellant. The respondent admitted misconduct and was afforded due process. Therefore, the dismissal was not wrongful and the award of damages and interest was set aside.
