Ratio Decidendi

The High Court of Zambia lacked jurisdiction because the Marine Policy required disputes (other than non-disputed premium collection) to be resolved by arbitration or, if litigation was chosen, in Belgian courts under Belgian law. The action was improperly commenced in Zambia, and the lower court erred in failing to enforce the jurisdiction and arbitration clauses. The Insurance Act No. 27 of 1997 applied to the policy, but its breach did not render the contract void; however, the agreed forum and law were determinative.
