  1. 1 Whether the Defendants have illegally encroached on property known as farm number 2038
  2. 2 Whether farm 2038 exists as a distinct property from farm 604
  3. 3 Whether the Plaintiff's certificate of title is valid and conclusive

Ratio Decidendi

The Plaintiff's certificate of title for farm 2038 is valid and conclusive evidence of ownership. The Defendants' claims of adverse possession and fraud are unsubstantiated and not specifically pleaded or proved. The existence of farm 2038 is confirmed by the Ministry of Lands records. The only way to resolve the dispute and determine any encroachment is by a government survey to establish the boundaries of farm 2038 and farm 604. The Defendants must allow such a survey, and if encroachment is established, they must vacate the affected portion.
