Ratio Decidendi

The Plaintiff failed to discharge the burden of proof as it did not provide sufficient documentary evidence (invoices, delivery notes, site meeting minutes) to prove the works done and amounts claimed. The doctrine of privity of contract precludes the Plaintiff from claiming against the 2nd defendant, as there was no executed novation or assignment.
