Ratio Decidendi

The Respondent was not entitled to deduct or withhold legal fees from the judgment sums recovered for the Appellant, as costs were to be recovered from the losing party per binding precedent. The Respondent also failed to properly render a bill in accordance with Order 50 Rule 2 before commencing action for recovery of fees. The trial court erred in distinguishing the facts from Kuta Chambers and in awarding sums to the Respondent.
