The appellants were lawfully dismissed for participating in an illegal strike during the subsistence of the Disciplinary Code and Collective Agreement. The claim for terminal benefits due to change in company status fails as there was no change of employer. The appellants are entitled to payment for leave days as admitted by the respondent. The respondent is entitled to damages for loss of business caused by the illegal strike, to be assessed. Each party to bear its own costs.
