Civil Appeal / Judgment on Appeal From High Court

  1. 1 Whether the respondent is a beneficiary of the estate of the late Mrs. Daisy Butts
  2. 2 Whether the respondent is entitled to collect rentals from Plot No. 403, Monze
  3. 3 Whether the appellants are entitled to title deeds for sub-divisions of Plot No. 403, Monze

Ratio Decidendi

The property in question vested in the two sons upon the death of Fredrick Charles Butts, and Mrs. Daisy Butts only had a life interest which expired upon her death. The Trusts Restriction Act did not vest the property absolutely in Mrs. Daisy Butts. The appellants did not acquire valid title as the purported vendors had no authority to sell. Acquisition of title by adverse possession is barred by statute for registered land. The Lands Tribunal lacked jurisdiction to remove a trustee from the title; only the High Court could do so.

Court Disposition

Appeal dismissed

Orders

  • Costs awarded to the respondent, to be taxed in default of agreement
  • Proceedings of the Lands Tribunal over the property declared a nullity for lack of jurisdiction
