Ratio Decidendi

The High Court Rules are inapplicable to judicial review proceedings, which are governed exclusively by Order 53 of the Rules of the Supreme Court. Only persons who themselves show sufficient interest may apply to be heard; appellants cannot seek to join a third party on their perceived behalf. The clearance of Dr. Kalumba by the Tribunal is not subject to judicial review by the appellants, and the trial judge was correct in refusing the application to join or notify Dr. Kalumba. The stay of proceedings pending appeal was properly granted due to public interest considerations.
