Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether failure to explain the defence in the proviso to Section 138(1) of the Penal Code at the second plea was fatal to the prosecution's case
  2. 2 Whether the trial magistrate erred in not considering the appellant's evidence regarding the defence in the proviso
  3. 3 Whether the sentence of 20 years was excessive given the appellant was a first offender

Ratio Decidendi

The appellant was not prejudiced by the failure to re-explain the proviso at the second plea as he was aware of the defence and raised it himself. There was no evidence during trial to support the defence in the proviso. The sentence of 20 years was not excessive given the aggravating factor of the use of a knife. The order that the sentence should run from the date of arrest was wrong as the appellant was released on bail and should run from the date of conviction.

Court Disposition

Appeal dismissed; sentence affirmed with modification on commencement date.

Orders
