The Respondents failed to show sufficient reason or evidence to justify payment by instalments. The Applicant is entitled to judgment for the outstanding sum, interest, foreclosure, and sale of the mortgaged property and charged assets, with recourse to the guarantors if proceeds are insufficient.

  • Respondents to pay K11,090,628.79 as at 30th September, 2015, less K100,000 paid on 11th November, 2015, with contractual interest to date of judgment, thereafter at Bank of Zambia lending rate.
  • Payment to be made within 60 days; in default, Applicant may foreclose and sell Stand No. 2486, Kitwe and charged assets.
