Procedural Posture

Originating Notice of Motion for Non Conviction Based Forfeiture / Judgment

  1. 1 Whether the properties in question are tainted properties liable to forfeiture under the Forfeiture of Proceeds of Crime Act
  2. 2 Whether the applicant has discharged the burden of proof to establish the properties are proceeds of crime
  3. 3 Whether the interested party has demonstrated a legitimate interest in the properties

Ratio Decidendi

The applicant established, on a balance of probabilities, a reasonable factual basis to suspect the properties are proceeds of crime, as the interested party's known income was grossly insufficient to fund the developments and no credible evidence of legitimate funding was provided. The interested party failed to discharge the evidentiary burden to demonstrate a legitimate source of funds or interest in the properties beyond mere ownership. The properties are therefore tainted and liable to forfeiture to the State under the Forfeiture of Proceeds of Crime Act.

Court Disposition

Application granted. Properties forfeited to the State.
