Ratio Decidendi

Section 219(1) of the Roads and Road Traffic Ordinance creates two offences: failing to stop and failing to render assistance. The Second Schedule only permits suspension of a driving licence where there is a failure to stop and render assistance. Since the appellant was convicted only of failing to render assistance, suspension of his licence was ultra vires.
