The Plaintiff satisfied the requirements for admission of fresh evidence: the application letter existed at the time of trial but was lost despite diligent search, it is relevant and material to the case, and is credible as evidenced by the Ministry of Lands stamp and Police report. The interests of justice require the Plaintiff be allowed to adduce the document, and the Defendants will not be prejudiced as they are given an opportunity to respond.
