The respondent was wrongfully and unfairly dismissed as he was not formally charged, not given an opportunity to be heard, and did not admit the offence. The employer failed to follow its disciplinary procedure and rules of natural justice. The award of 24 months' salary as damages was justified given the circumstances. However, the award of costs was set aside as there was no misconduct by the appellants to warrant costs.
