Ratio Decidendi

The conviction for defilement was unsustainable as the evidence showed the victim was above 16 years. Section 186 of the Criminal Procedure Code does not permit substitution of a conviction for rape in place of defilement, but allows substitution for indecent assault. There was sufficient corroboration of the victim's testimony through her distress and attempted suicide. The conviction for defilement is quashed and substituted with a conviction for indecent assault, with the maximum sentence imposed.
