Procedural Posture

Election Petition Appeal / Final Appellate Judgment

  1. 1 Whether the 'Serial Killer' tag attached to the appellant during campaigns constituted an illegal practice affecting the election result
  2. 2 Whether sufficient evidence was adduced to prove the respondent or his agents engaged in character assassination
  3. 3 Whether the trial judge erred in findings of fact regarding the allegations

Ratio Decidendi

The appellant failed to adduce sufficient and credible evidence to prove that the respondent or his agents labeled him a 'Serial Killer' during campaign meetings or that such conduct affected the election result. The trial judge's findings of fact were not perverse and properly considered the evidence and witness credibility. There was no basis to nullify the election under Section 93(2) of the Electoral Act.
