Ratio Decidendi

The court held that interest is payable on a rendered bill at a rate determined by the court from the date of presentation of the bill where taxation is not demanded; if taxation is demanded, interest is payable from the date of taxation. Since the bill was settled after more than six years and no taxation was demanded, interest was properly awarded at the Bank of Zambia lending rate from one month after the bill was delivered until payment.
