Leave to amend the Defence to include allegations of fraud was refused because the application was made 17 years after commencement of proceedings, after the original Plaintiff's death, and after trial had begun. The necessity for amendment was apparent long ago, and granting it now would prejudice the Plaintiff, who as administratrix cannot properly respond to the allegations. The amendment would introduce a new and distinct defence too late in the proceedings, contrary to established legal principles.
