The consent judgment was invalid as it was not signed by all parties as required by law. However, the notice of discontinuance filed by the 1st applicant was valid despite procedural defects in service, as such defects are curable and do not affect the substantive right to discontinue. The lower court erred in holding otherwise and in refusing to recognize the change of advocates. The only surviving action is between the 2nd respondent and the appellants and interested party.
