Ratio Decidendi

Article 98(1)(b) of the Constitution does not require ratification by the National Assembly for the reappointment of judges who have already been ratified for their positions; the President has exclusive discretion in such reappointments. Judges cannot be sued for acts done in their judicial capacity, and the Attorney-General cannot be sued vicariously for judicial acts. The High Court's interpretation was correct as the constitutional provisions were clear and unambiguous.
